1. What Vacation Notice does

Vacation Notice is an AI-powered travel itinerary platform. We create personalized travel-planning content, including free previews and paid digital itineraries, with the help of artificial intelligence and automated quality checks.

We are not a booking agency. We do not make reservations, arrange transportation or accept payment for travel services on your behalf. Hotels, restaurants, tours and other suggestions in an itinerary are recommendations only. If you decide to book, you book and pay the provider directly, on that provider's terms.

Prices, availability, opening hours, schedules and travel times are estimates and can change. Always confirm details directly with the provider before you travel. You are responsible for your own travel documents, visas, health requirements, insurance and safety decisions.

For cruise port days, independent shore activities are not guaranteed to return before your ship departs. You are responsible for being back on board on time.

2. Eligibility and accounts

You must be at least 18 years old to purchase or create an account. You agree to provide accurate information and to keep your sign-in links private. You are responsible for activity under your account and on any itinerary link you share.

3. Purchases, pricing and refunds

Paid itineraries are one-time purchases of digital content. Prices are shown in U.S. dollars at checkout. Payments are processed by our payment provider, Stripe; we do not store your full card details.

Your itinerary is generated after payment is confirmed and is typically delivered within minutes. Each plan includes the number of revisions stated at purchase.

Refunds. You can request a refund within 7 days of purchase if your itinerary could not be generated, if a material technical problem prevents you from using it and we cannot fix it, or if you were charged more than once. Itineraries that were successfully delivered are generally not refundable if you simply change your mind, but you can use your included revisions. Approved refunds go back to your original payment method through Stripe. Full details are in our Refund Policy. Nothing in these Terms limits any rights you have under applicable consumer protection laws.

4. Affiliate links and third-party services

Some links in our Services are affiliate links, including links to Viator. If you book through them, we may earn a commission at no extra cost to you. Experience listings, ratings and "from" prices are provided by Viator; bookings, cancellations and customer service for those experiences are handled by Viator and the tour operator.

We are not responsible for third-party websites, products or services, or for their content, availability or conduct.

5. Text messaging (SMS) terms

If you provide your mobile number and check the box to receive text messages from Vacation Notice, you agree to receive recurring automated text messages at that number, including messages sent using automated technology. Your consent is not a condition of purchase.

  • Program name: Vacation Notice Alerts.
  • What you will receive: trip-planning and order updates (for example, that your itinerary is ready), replies to your questions, pre-trip reminders and, only if you separately opt in, occasional travel inspiration and offers.
  • Message frequency varies. Typically no more than 4 messages per week.
  • Message and data rates may apply. Check with your mobile carrier for details.
  • To opt out, reply STOP to any message. You will receive one confirmation message and no further texts unless you opt in again. You can also reply CANCEL, END, QUIT or UNSUBSCRIBE.
  • For help, reply HELP or contact us at [email protected] or +1 (917) 421-2054.
  • Consent to receive marketing text messages is not a condition of any purchase.
  • Mobile carriers are not liable for delayed or undelivered messages.

You confirm that you are the account holder or have the account holder's permission to enroll the number. If you change or deactivate your number, please text STOP from it first or tell us at [email protected].

We handle your mobile information as described in our Privacy Policy. We do not sell or share your mobile number or text-messaging opt-in data with third parties or affiliates for their marketing or promotional purposes.

Supported carriers include major U.S. carriers; service may not be available on all carriers or devices.

6. Emails

We send service emails about your purchase and account. With your consent we may also send trip ideas and offers; every marketing email includes an unsubscribe link.

7. Acceptable use

You agree not to misuse the Services, including by attempting to access them through automated means at scale, interfering with their operation, reselling itineraries as your own product, or submitting unlawful or harmful content.

8. Intellectual property

The Services, our brand, logos and site content are owned by Dueitt Consulting Group LLC or its licensors. Your purchased itinerary is licensed to you for personal, non-commercial use; you may share it with the people you are traveling with. Photographs from third-party sources remain the property of their owners and are credited where shown.

9. Your content and photos

You keep ownership of anything you send us, such as trip details or photos. You give us permission to use trip details to provide the Services. If you tag @vacationnotice in a public post, we will ask for your permission before reposting your photo.

10. Disclaimers

The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and accuracy of third-party information. AI-generated content may contain errors; please use your own judgment.

11. Limitation of liability

To the fullest extent permitted by law, Vacation Notice and Dueitt Consulting Group LLC will not be liable for indirect, incidental, special or consequential damages, or for losses arising from travel arrangements, third-party providers, missed connections or departures, or events beyond our control. Our total liability for any claim relating to the Services is limited to the amount you paid us for the itinerary giving rise to the claim. Some jurisdictions do not allow certain limitations, so these may not apply to you.

12. Indemnity

You agree to indemnify and hold harmless Dueitt Consulting Group LLC from claims arising from your misuse of the Services or violation of these Terms.

13. Governing law and disputes

Talk to us first. If you have a problem with the Services, please email [email protected] with your name, your order details and what went wrong. We will reply within 5 business days and work with you in good faith to resolve it. If we cannot resolve it within 30 days, either of us may take the matter further.

Governing law. These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. This does not take away any protection you have under the consumer laws of the place where you live that cannot be waived by agreement.

Where claims are heard. Claims may be brought in small claims court where you qualify, or in the state or federal courts located in San Diego County, California, unless the law gives you the right to bring your claim where you live.

We do not require arbitration, and nothing in these Terms waives your right to go to court or to take part in a class action where the law allows it.

14. California residents

Under California Civil Code Section 1789.3, California users are entitled to the following consumer rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

Vacation Notice sells digital travel-planning content. We do not book, reserve or arrange transportation or other travel services, and we do not accept payment for them; customers book and pay third-party providers directly.

15. Changes to these Terms

We may update these Terms. The effective date above shows when they last changed. Material changes will be posted here and, where appropriate, sent by email. Continued use after changes means you accept them.
